The Brazil Rescisão Trabalhista Calculator estimates the verbas rescisórias — the bundle of termination payments owed to a CLT employee when an employment contract ends. The exact mix depends on who ends the contract and why, so the tool models the three main scenarios: dismissal without cause (sem justa causa), resignation (pedido de demissão), and dismissal for cause (com justa causa).
How it works
The calculator builds the payout from these components, each gross:
- Saldo de salário — pay for days worked in the final month:
(salary / 30) × days worked. - Férias proporcionais + 1/3 —
(salary / 12) × monthsof accrued vacation, plus a one-third constitutional bonus on that amount. - 13° salário proporcional —
(salary / 12) × months worked in the calendar year. - FGTS fine — on dismissal without cause, 40% of the FGTS deposited. The tool estimates the FGTS balance as 8% of salary per month worked, or you can enter the exact balance.
Which components apply depends on the termination type:
sem justa causa → saldo + férias prop. +1/3 + 13° prop. + 40% FGTS fine
pedido demissão → saldo + férias prop. +1/3 + 13° prop. (no FGTS fine)
justa causa → saldo only (proportional férias and 13° are forfeited)
Example and notes
An employee earning R$3,000/month, with 6 months in the current acquisitive year, 6
months worked this calendar year, and 10 days in the final month, dismissed without
cause, receives: saldo (3000/30)×10 = R$1,000; proportional férias (3000/12)×6 = R$1,500
plus R$500 terço; proportional 13° (3000/12)×6 = R$1,500; and a 40% FGTS fine on an estimated
balance of 3000×0.08×6 = R$1,440, i.e. R$576. These figures are gross — INSS and income
tax are withheld separately, and aviso prévio rules add further detail. Use a contador or the
